The effective date of disability will be one of the following dates.
The date that SSA reports as the disability onset date for SSI or SSDI eligibility based on an approved disability decision for SSI, SS DI, Disabled Widow/Widower, or Disabled Adult Child beneficiary benefits.
The date the State Medicaid Disability Office reports as the disability start date on the Form 121.
Consider the individual disabled for the whole month when the disability onset date is anytime during that month.
Consider a baby to be disabled from birth if the baby is born in a hospital, AND
SSA or State Medicaid Disability Office disability onset date is during the hospital stay; OR
The baby dies in the hospital without ever being away from the hospital for longer than 23 hours at any one time. In this circumstance, you do not have to ask for a disability decision from the MRB, even if the month of death is different than the month the infant was born.
