355 Subsidized Adoption Medicaid

Previous Policy

 

A.  General Requirements

A child is eligible to receive Medicaid when a current adoption assistance agreement is in effect with a state or local government agency. There is no income or asset test. DHHS determines the Medicaid eligibility.

1.    Age

The adoption assistance agreement usually ends the month that the child turns 18. However, the adoption assistance agreement may be extended through the month in which the child turns 21 if the child is determined to be physically, mentally, or emotionally disabled by the agency originating the adoption assistance agreement. A member continues to receive SA Medicaid as long as the adoption assistance agreement is in effect. 

2.    Family Medicaid Programs and the Subsidized Adoption child

An SA child can be the dependent child for Family Medicaid Programs when there are no other eligible children in the home. Treat them the same as an SSI child. They are NOT included in the household size and their income and assets are NOT counted.

NOTE:  Generally, an SA child is not included in Family Medicaid programs. However, IF including an SA child is beneficial (IE, to increase household size), they may be included. an SA child remains eligible for SA Medicaid separately.

3.    Title IV-E Subsidized Adoption Child

When a Title IV-E child lives in Utah, Utah is responsible to provide Medicaid for the child.

4.    Non-Title IV-E Subsidized Adoption Child

Utah is responsible to provide SA Medicaid for a child when:

If the state is not part of ICAMA, the child is not eligible for SA Medicaid in Utah.

When a child becomes ineligible for Subsidized Adoption Medicaid, always review the member for eligibility under other medical programs (827).

 

B.  Interstate Agreements

 

States periodically join the ICAMA, so if the state is not on the list, contact the state to verify whether or not that state is a member, or contact the Utah ICAMA Administrator (See Table IX).  Current members of the ICAMA are:
