Medicaid Policy
This waiver is for people at least 18 years of age that require a nursing home level of care and have lost the use of at least two limbs. People on this waiver must be aged, blind or disabled.
DSPD determines the need for the level of care for this waiver.
The Physical Disabilities Waiver may not be available in all areas of the state. The local DSPD Agency can tell individuals if the waiver is available in their area.
Income Requirements
Use only the individual's total income. Only the following types of income are not considered:
Austrian Reparation Payments
German Reparation Payments made by the Federal Republic of Germany.
Japanese and Aleutian Restitution Payments.
Netherlands Reparation Payments based on Nazi, but not Japanese, persecution during World War II.
Payments from the Agent Orange Settlement Fund or any other fund established pursuant to the settlement regarding Agent Orange product litigation.
Radiation Exposure Compensation.
VA pensions limited to $90 per month under 38 U.S.C. 5503
Compare the individual's total income to 300% of the SSI rate (Table II).
If the income is less than or equal to 300% of the SSI rate, then the member keeps all of the member’s income. The member will not have a contribution to the cost of care.
If the income is more than 300% of the SSI rate, the member's contribution to the cost of care will be the difference between the member's income and 100% FPL limit used for the ABD programs. Determine countable income and deductions the same way you do for ABD spenddown Medicaid.
