394-2 Immigration Status for RMA

To be eligible for RMA, a person must have one of these statuses (all are considered refugees under RMA):

  1. A person who is a refugee under Section 207 of the Immigration and Nationality Act (INA).

  2. A person who has been granted political asylum under Section 208 of the INA.

  3. A person who has been paroled under Section 212(d)(5) of the INA as a refugee or asylee. 

  1. A Cuban or Haitian entrant.

  2. Amerasian Immigrants. 

  3. Children of a refugee family who are born in the U.S.  These children have the same non-citizen registration number as their mother with a suffix of 01, 02 etc.  The suffix shows the sequence of birth in the U.S. These children are eligible for RMA if not eligible for any other Medicaid program. See 394.

  4. Non-citizens certified as Victims of Severe Forms of Trafficking. These non-citizens have been certified by the Federal Office of Refugee Resettlement (ORR) and have been issued a Certification Letter.

  1. Certain family members of Victims of a Severe Form of Trafficking.

  2. Iraqi or Afghan Special Immigrant Status granted under section 101(a)(27) of the INA.
