394-3 Refugee Entry Dates

Effective Date: May 1, 2008

Contact DHHS Policy Specialist for Previous Policy

 

Determine the entry date as follows:

Refugees

Use the entry date on the USCIS documents.

Asylees

Use the date asylum was granted as the date of entry. 

 

U.S. born children of a refugee

Use the entry dates of their parents. If the parents have different entry dates, use the entry date of the mother.

Victims of a Severe Form of Trafficking

Use the certification date that appears in the certification letter issued by ORR. For family members, use the date stamped in their passport or on their I-94 arrival record.

 

Iraqi and Afghan Special Immigrants

Use the date of the DHS stamp or notation on the passport or the I-94 showing the date of entry, or the date on the I-551.  See 205-2 for verification of status.
