417-17 Public Assistance Exclusions

Public Assistance

 

Do not count the following types of payments as income:

 

1.    Family Employment Program

2.    Workforce Innovation and Opportunity Act

3.    Child Care Assistance

4.    Refugee Cash Assistance

5.    Subsidized Adoption Payments

6.    Supplemental Nutritional Assistance Program (SNAP)

7.    Surplus food donated by the USDA

8.    Energy assistance payments

·       HEAT payments

·       Utility payments made by other agencies

·       Weatherization improvements to a individual's home provided by other agencies.

 

9.    WIC vouchers

10.  Reimbursement from the Child Care Food Program (CCFP)

11.  Supplement food assistance received under the Child Nutrition Act of 1966

12.  Food service program for children under the National School Lunch Act.

13.  Y and Z funds paid by the Department of Workforce Services.

14.  Refunds of Medicare Premiums from the Social Security Administration.

15.  Payments or the value of payments for Attendant Care from DSPD or other agencies.  This includes people receiving these services under a Home and Community-based waiver program. 

16.  Money a disabled person receives from DSPD to pay for attendant care if:

a.    The money is used to pay for attendant care, and

b.    The person providing the care is not financially responsible for the person receiving the care.

17.  SSI payments or state supplemental payments for the individual receiving SSI or state supplements to determine the individual's eligibility.

a.    Do not count any other income of the SSI recipient.

b.    For 100% FPL Medicaid and the Medicare Cost-Sharing programs, count income other than the SSI payment to determine eligibility of an SSI recipient's aged, blind or disabled spouse who does not receive SSI and is not 1619(b) eligible. (See 410-2)  

·   If the spouse fails the 100% FPL Medicaid program, do not deem any income from the SSI or 1619(b) recipient to the spouse to determine the spouse's eligibility under the spenddown Medicaid program. (See 410-2)

c.    Count SSI payments for members approved for the Home and Community Based Services Waiver (except for the New Choices Waiver) and members in medical institutions.

·   See section 463 for more information about how to count SSI income for the first 3 full months a member enters a medical institution.

d.    Count $15 SSPs received by Medicaid members in nursing homes who also receive the SSI payment that is limited to no more than $30.

 

                       i.    The $15 SSP is included in the member’s total income used to determine the member’s contribution to cost of care .

                      ii.     See subsection 661 for a description of the $15 SSP.

 

18.  Do not count payments from a Federal, State, or local government program if it is given to help the member get medical or social services. This includes cash payments from a government program for vocational rehabilitation.
