Medicaid Policy
A. Property
· Exclude any property, including real property and improvements, held in trust, subject to federal restrictions, or otherwise under the supervision of the Secretary of the Interior located on a reservation including any federally recognized American Indian tribe's reservation.
o This includes former reservations in Oklahoma, Alaska Native regions established under the Alaskan Native Claims Settlement Act and Indian allotments on or near a reservation as designated and approved by the Bureau of Indian Affairs or the Secretary of the Interior.
o For any other federally recognized Indian Tribe, which does not fall under the above definition, exclude property that was within the most recent boundaries of a prior Federal reservation.
B. Ownership Interest
· Exclude from resources any ownership interests in rents, leases, royalties or usage rights related to natural resources.
o This includes any extraction of natural resources such as the extraction of minerals, oil, gas, plants and plant products, animals, fish and shellfish resulting from the exercise of these federally protected usage rights.
C. Funds in II-M Accounts
· Exclude funds held in an Individual Indian's account (II-M account) that is managed or controlled by the Bureau of Indian Affairs or the tribe and to which the individual does not have direct access.
D. Culturally Significant Items
· Exclude ownership interests in or usage rights to items that have unique religious, spiritual or cultural significance that support daily needs or a traditional lifestyle according to applicable Tribal law or custom.
