Medicaid policy allows certain assets an individual or spouse owns to be excluded from countable resources when those resources are set aside and clearly designated to pay the expenses of burial for the individual or the individual's spouse. For Family Medically Needy programs, an exclusion is available for each eligible family member.
Burial Spaces versus Burial Funds: Burial funds do not include the value of fully paid burial spaces.
• If the individual has fully paid burial spaces, use the burial space exclusion described in Section 591 to exclude the spaces.
• If the individual has an installment contract to purchase burial spaces, use the burial fund exclusion to exclude the value of funds paid on the burial space installment agreement when the contract for the spaces is not fully paid and the burial fund exclusion has not been used to exclude other burial resources.
