Contact DWS Program Specialist for Previous Policy
This waiver is for children under age 21 or who qualify for waiver services by the month in which they turn 21 and rely on medical devices for life support. Clients who qualify for the waiver by the month they turn 21 remain age eligible for TDW after age 21. People on this waiver must meet a disabled, blind, child or family Medicaid category.
DCFHS determines the need for the level of care for this waiver.
Use only the client’s total income. Only the following types of income are not considered:
Austrian Reparation Payments
German Reparations Payments made by the Federal Republic of Germany.
Japanese and Aleutian Restitution Payments.
Netherlands Reparation Payments based on Nazi, but not Japanese, persecution during World War II.
Payments from the Agent Orange Settlement Fund or any other fund established pursuant to the settlement in regard to Agent Orange product liability litigation.
Radiation Exposure Compensation.
VA pensions limited to $90 per month under 38 U.S.C. 5503.
From total income subtract:
100% FPL for the person’s needs.
Earned income deduction equal to Substantial Gainful Activity for disabled and blind individuals (Table II).
Deduction for a spouse (409-11).
Deduction for a dependent family member (409-12).
Deduction for health insurance and medical expenses (409-1, 409-14, 415-5).
Any amount left is the amount of contribution to cost of care.
