A. Non-Emergency Medicaid Programs
o There are no special considerations for ineligible aliens for deeming income or determining household size. Follow the rules for the program type for which you are determining eligibility.
o For MAGI-based coverage groups, an ineligible alien may be included in the MAGI household depending on whether the ineligible alien will be claimed as a dependent on a tax filer's tax return. For non-tax-filing households, the ineligible alien may be included in the MAGI household size depending on the relationship to the other household members. However, the ineligible alien cannot receive regular Medicaid coverage.
o Do not include any ineligible alien family member in the coverage for non-emergency Medically Needy Family programs.
B. Emergency Medicaid Programs
o Follow the income deeming and household size rules for the program type for which you are determining eligibility. For MAGI-based coverage groups, follow the rules on how to build the MAGI household.
o Do not include any U.S. citizen or eligible qualified alien family member in the coverage for an Emergency Medicaid program.
o Do not deem income from an alien's sponsor who is not a spouse or parent living with the alien on an Emergency Medicaid case.
