596-2 Revocable Burial Trust

A burial trust is revocable if the individual who established the trust or someone acting for the individual can change or end the trust during the individual’s lifetime.

 

Use the burial fund rules in 592 to decide if you can exclude any part or all of the revocable burial trust as a burial fund.

If the individual placed fully paid burial spaces in the revocable burial trust, apply the burial space rules in 591 to the burial spaces.  The individual must verify the fully paid burial spaces.  Evidence may be a copy of a fully paid contract for burial spaces or a deed for a cemetery lot, etc.  

Use the trust rules in 512-1 or 512-2 when an individual owns a revocable burial trust and part or all of the revocable burial trust is not excluded as a burial fund or as burial spaces.
