Medicaid Policy                                                                 

 

401-5 Household Size and Ineligible Non-Citizens

A.   General Requirements

 

There are no special considerations to determine Medicaid eligibility for households that contain both eligible and ineligible non-citizen members.

 

 

B.   Non-Emergency Medicaid Programs

 

1.    Follow the rules for the program type for which you are determining eligibility.

·       For MAGI-based coverage groups, follow the rules on how to build the MAGI household (401 through 401-3).   

·       For Medically Needy Family programs, follow the rules found in sections 404-1 through 404-4.

·       For ABD programs, follow the rules found in 408-1 through 408-6.

 

2.    Do not include ineligible non-citizen family members in the coverage for non-emergency Medicaid, but count them in the household size.

 

C.   Emergency Medicaid Programs

 

1.    Follow the income deeming and household size rules for the program for which you are determining eligibility.

·       For MAGI-based coverage groups, follow the rules on how to build the MAGI household (401 through 401-3).

·       For Medically Needy Family programs, follow the rules found in sections 404-1 through 404-4.

·       For ABD programs, follow the rules found in 408-1 through 408-6.

  

2.   Do not deem income from a non-citizen's sponsor who is not a spouse or parent living with the non-citizen on an Emergency Medicaid case (205-4, 205-5).

 

3.    Do not include any U.S. citizen or qualified non-citizen family member in the coverage for an Emergency Medicaid program.  Family members who are U.S. citizens or qualified non-citizens may count in the household size for the ineligible non-citizen seeking emergency Medicaid.
